Welcome to Prime Care. These Terms of Service ("Terms") govern your use of our website and our service. By using Prime Care, you agree to these conditions.

1. Corporate Information and Governing Law

Prime Care is operated by Prime Care AG, a company registered in Switzerland.
Governing Law: These Terms are governed by the Swiss Code of Obligations (Art. 184 et seq. OR)¹ regarding sales contracts.
Jurisdiction: Any disputes shall be settled under the exclusive jurisdiction of the courts of Switzerland.

2. Contract Conclusion

The presentation of products is an invitation to treat. A binding contract is formed only when we confirm your order via email, in accordance with Art. 184 of the Swiss Code of Obligations.

3. Payment Processing and Security

All payments are processed via payment provider.
Compliance: Transactions are handled in accordance with the Payment Card Industry Data Security Standard (PCI DSS).
Legal Basis: Payment procedures comply with the Swiss Federal Act on Data Protection (nFADP) and the EU GDPR regarding financial data security.

4. Shipping, Customs, and Duties

We utilize Swiss Post and FedEx for global logistics.
USA Shipments (DDP): For customers in the United States, Prime Care acts as the Importer of Record. Orders are sent Delivered Duty Paid (DDP) as defined by Incoterms® 2020². We cover all US Customs duties and taxes.
Rest of World (DAP): For all other countries, orders are shipped Delivered At Place (DAP). Per US CBP (19 CFR)³ and EU Customs Regulations (Regulation (EU) No 952/2013)⁴, the customer is responsible for local taxes and duties.

5. Age Restrictions and Regulated Products

Some of our health products (e.g., alcohol-based supplements) are restricted to adults.
Compliance: We comply with the Swiss Alcohol Act and the US Children's Online Privacy Protection Act (COPPA)⁵. By purchasing restricted items, you certify you are at least 18 years of age.

6. Right of Withdrawal and Returns

EU/UK Consumers: In accordance with Directive 2011/83/EU⁶ and the UK Consumer Contracts Regulations 2013, EU/UK residents have a 14-day right of withdrawal.
Hygiene Exemptions: Per Art. 16(e) of Directive 2011/83/EU, sealed health and cosmetic goods are exempt from return once the seal is broken.

7. Disclaimer of Warranties

Products are sold "as is." While we guarantee Swiss quality, Prime Care complies with the Magnuson-Moss Warranty Act (US)⁷ regarding consumer product warranties and the Swiss Law on Product Liability (PrHG).
